In accordance with the commitment and care that CGF Design S.r.l. dedicates to the protection of personal data, we inform you on the methods, rights, purposes and scope of communication and dissemination of your personal data, in accordance with art. 13 of the European Regulation 679/2016. The website is owned and managed by CGF Design S.r.l. (for company data see par. 3). This privacy policy is rendered only for this site and not for third party websites possibly consulted by the user through links.

 
 

1. Purpose and methods of processing

 

In order to offer you the services provided by its websites, CGF Design S.r.l., in its capacity as Data Controller, must process certain personal data necessary for the provision of services.
These data may be provided implicitly by the tools you use to access and use the services or explicitly by you while browsing

1. Any data acquired, always in compliance with the regulations in force, will be processed for institutional purposes, connected and/or instrumental to the provision of access to this site, including any additional services requested by the user; in particular:

  1. To carry out a service (such as access to the site with all its functions). To this end, the data may be communicated to third parties whose collaboration CGF Design S.r.l. may and/or must avail itself of for the fulfilment of the aforementioned purposes. It is in any case possible to consult the site without supplying any personal data, even if some functions will not be available and some services cannot be supplied, as set out and specified according to the cases also in this privacy policy;
  2. To perform, in general, legal obligations;
  3. For operational and management requirements internal to CGF Design S.r.l. and inherent to the services offered.

2. In the event of explicit and optional manifestation of consent, the data shall be processed for marketing and/or commercial promotion purposes, including the sending of printed and/or digital advertising material, relating to the services offered by CGF Design S.r.l. Further details are available in art. 5.

3. The data shall be processed lawfully and fairly and used only for the purposes set out in the preceding paragraphs; for further details, please also refer to Article 5. The data will be processed using instruments that guarantee security and confidentiality, and may be processed using paper and/or automated instruments to store, manage and transmit the data. The data will be kept for the time prescribed by law.

CGF Design S.r.l. shall process the data to be conferred for the entire duration of the performance of the services requested and shall keep them for the following 12 months for the purpose of completing administrative activities, as well as for the time necessary to fulfil legal obligations.
If you have authorised the processing of profiling, the anonymous data observed from time to time will be deleted 12 months after the start of the processing.

2. Nature of the provision of data and consequences of a refusal to answer

The provision of consent to the processing of data for the purposes referred to in Article 1, paragraph 1, is compulsory exclusively for the purposes indicated in relation to each service: for example, a refusal to consent to the processing thereof may prevent the conclusion or execution of contractual relationships or the fulfilment of legal obligations or the consultation of the website with all its functionalities. The user is informed of this in the manner appropriate to each specific case, but in any case the user may consult the website also by denying consent to the processing of personal data, where required; in this case, certain functions or features may be disabled.

2. The provision of consent to the processing of data for the purposes referred to in Section 1, Paragraph 2 is optional. Failure to provide consent has no consequences, unless explicitly stated otherwise before consent is given (e.g. impossibility to receive advertising material).

  • The data and cookies you receive will be processed by CGF Design S.r.l. exclusively with the methods and procedures necessary to provide you with the requested services and for the further purposes for which you have given your consent.
  • Direct marketing purposes. Only with your express consent may the data be used to carry out statistical analyses, market surveys, promotional activities and to send commercial information on the products and promotional initiatives of CGF Design S.r.l.
  • Profiling purposes. Again with your consent, the data may be used for automatically conducted profiling purposes, collecting information about your browsing when accessing and using the services. By means of statistical correlation algorithms, the data is combined with identical information from other users to identify common traits and create classes of interest. By assigning your browser to a class of interest, our systems will be able to offer content that is close to your tastes and present advertising contributions that better meet your needs and better target the interests of advertisers by reducing the level of disruption to your browsing experience. As of the date you read this Policy, CGF Design S.r.l. uses profiling data to aggregate marketing profiles, to manage advertisers and to improve campaigns.
  • Marketing purposes by third parties. With your explicit consent, your data may be provided to other companies, who may contact you as the owner of autonomous initiatives for statistical analysis, market surveys and sending commercial information on products and promotional initiatives.
  • Communications for market surveys or for commercial information on products and promotional initiatives may be made by postal mail, e-mail, telemarketing, sms, mms.
  • We would like to inform you that some activities may be implemented through suppliers, specifically appointed as data processors, also residing outside the European Union.
  • The legal basis for the purposes described above is the execution of your request as a data subject as well as for the consents you have given.

3. Data controller

 

1. Following consultation of this site and the use of one or more services, data relating to identified or identifiable persons may be processed. The holder of their processing is CGF Design S.r.l. (P.IVA: 11421150019), with registered office in Pianezza (TO), Via Ivrea, 9.

4. Place of Data Processing

 

1. The processing operations connected to the web services of this website are carried out at the head office of CGF Design S.r.l., except for the explicit exceptions, and are handled only by technical personnel of CGF Design S.r.l. in charge of the processing. The hosting service of the site is provided by Aruba S.p.A., which undertakes to guarantee the respect of the regulations in force. The data acquired via the web, or in any case deriving from the web services, may be communicated to the technological and instrumental partners of which the Data Controller avails itself in order to provide the services requested by users/visitors. CGF Design S.r.l. guarantees, in any case, compliance with the regulations in force as far as it is concerned.

5. Types of data processed/specific processing

 

1. Depending on the service rendered, different types of personal data may be processed, as specified in this Article. Each data subject is invited, in particular, to read Article 7 ('Rights of data subjects').

Your personal data will not be disclosed, but may be communicated where necessary for the provision of the service, to third parties (third party technical services, postal couriers, hosting providers, IT companies and others) appointed, if necessary, Data Processors by CGF Design S.r.l. for tasks of a technical or organisational nature, instrumental to the provision of services.

Access to data is also granted to categories of CGF Design S.r.l. employees involved in the organisation for data processing (administrative, sales, marketing, customer service, system administrators and others).

The updated list of Data Processors can always be requested from the Data Controller.

This is without prejudice to the right of communication to third parties if you have given your specific and optional consent.

5.1 Navigation data

1. The computer systems and software procedures used to operate this website acquire, in the course of their normal operation, certain personal data, the transmission of which is implicit in website navigation. This information is not collected in order to be associated with identified interested parties; however, by its very nature it could, through processing and association with data held by third parties, allow users to be identified. This includes IP addresses or domain names of the computers used by users who connect to the site, the URL addresses of the resources requested, the time of the request, the method used to submit the request to the server, the size of the file obtained in response, the numerical code indicating the status of the response given by the server and other parameters relating to the operating system and platform used by the user.

The above data are used for the sole purpose of obtaining anonymous statistical information on the use of the site and to check its correct operation; they are deleted immediately after processing. The data could be used to ascertain responsibility in the event of hypothetical computer crimes to the detriment of the site: except for this eventuality, at present the data on web contacts do not persist for more than seven days. With regard to cookies, please refer to Section 5.3.

5.2.1 Data provided voluntarily by the user (communications)

The optional, explicit and voluntary sending of communications by means of contact forms ("forms") on the site or by e-mail to the addresses indicated on this site entails the subsequent acquisition of the data communicated by the sender, including his or her e-mail address as well as any other personal data included in the message, and consent to receive any messages in reply to his or her communications.

Personal data provided in this way are used solely for the purpose of fulfilling or responding to requests submitted and are only disclosed to third parties if this is necessary for that purpose.

5.2.2 Data provided voluntarily by the user (to receive communications for marketing and/or sales promotion purposes)

Each interested party may voluntarily provide his/her personal data to CGF Design S.r.l. in order to receive commercial or promotional communications, however denominated, with both digital and paper communications. In every communication the interested party is reminded that he/she may revoke his/her consent at any time and without formalities. The data shall be cancelled at the request of the interested party.

5.3.1 Cookies

What are they? Cookies are information stored by the browser when a website is visited with any suitable device (such as a PC, tablet or smartphone). Each cookie contains various data (e.g. the name of the server it comes from, a numeric identifier, etc.), may remain in the system for the duration of a session (until the browser is closed) or for long periods and may contain a unique identifier.

What are they used for? Cookies are used for different purposes depending on their type: some are strictly necessary for the proper functionality of a website (technical cookies), while others optimise its performance to offer a better user experience or enable the acquisition of statistics on the use of the site, such as analytics cookies, or allow personalised advertising to be displayed, such as profiling cookies.

How to disable them? You can disable cookies either through your browser settings (section 5.3.4. "How to disable cookies?") or through the mechanisms made available by certain third parties (section 5.3.3 "Cookies used on the site").

5.3.2 General types of cookies used on the site

Technical cookies: these are essential and necessary for the proper functioning of the site. They enable page navigation, sharing of our content, storage of login credentials to speed up login and keep preferences and credentials active while browsing. Without these cookies we could not provide the services for which users access the site.

Essential technical cookies for statistics and performance analysis: they allow us to know how visitors use the site, in order to be able to assess and improve its operation and favour the production of content that best meets the needs of our users. This category includes cookies supplied by partners of CGF Design S.r.l. as well as cookies supplied by third parties not directly controlled or controllable by CGF Design S.r.l.

Cookies from our partners allow us to offer enhanced functionality, as well as more information and personal features. This includes the ability to share content through social networks, access video-streaming services and the CDN networks on which we host our content.
These services are mainly provided by external operators hired or knowingly integrated by CGF Design S.r.l., If you have an account or if you use the services of these subjects on other websites, they may be able to know that you have visited our sites. The use of data collected by these third party operators through cookies is subject to their own privacy policies and we therefore identify these cookies by the names of the respective entities listed in the cookie management tool available in the appropriate section of this Policy. The cookies that do not come from partners of CGF Design S.r.l., are cookies conveyed without the control of CGF Design S.r.l., by third parties that have the possibility of intercepting the user during navigation also outside the CGF Design S.r.l. websites. 6. Changes to the privacy policy

 

1. This Privacy policy could be modified, also as a consequence of legislative or regulatory changes, technological evolutions and provision of new services or modifications of those already rendered. The user/customer is therefore invited to periodically consult the Privacy policy of CGF Design S.r.l.

7. Rights of the persons concerned

 

1. The data subject is 'the natural person to whom the personal data refer' (Article 4(1)(i) of Legislative Decree No. 196/2003). Any interested party has the right, at any time, to obtain confirmation of the existence or otherwise of such data and to know its content and origin, to verify its accuracy or to request its supplementation or updating or rectification (Article 7 of Legislative Decree No. 196/2003). Pursuant to the same article, data subjects have the right to request the deletion, transformation into anonymous form or blocking of data processed in breach of the law, as well as to object in any case, for legitimate reasons, to their processing. Article 7 of Legislative Decree 196/2003 is reproduced in full at the end of this privacy policy.

1. The data subject shall have the right to obtain confirmation as to whether or not personal data concerning him/her exist, even if not yet recorded, and communication of such data in intelligible form.

2. The person concerned has the right to be informed:

  • (a) the origin of the personal data;
  • (b) the purposes and methods of processing;
  • (c) the logic applied in the event of processing carried out with the aid of electronic instruments;
  • (d) the identification details of the holder, the persons responsible and the representative designated pursuant to Article 5(2);
  • e) the subjects or categories of subjects to whom the personal data may be communicated or who may become aware of them in their capacity as designated representative in the territory of the State, as managers or appointees.

3. The data subject has the right to obtain:

  • (a) the updating, rectification or, where interested therein, the integration of the data;
  • b) the deletion, transformation into anonymous form or blocking of data processed in breach of the law, including data whose retention is not necessary in relation to the purposes for which the data were collected or subsequently processed;
  • c) certification that the operations referred to in points a) and b) have been brought to the attention, also as regards their content, of those to whom the data have been communicated or disseminated, unless this proves impossible or involves a manifestly disproportionate effort compared to the right protected.

4. The data subject has the right to object, in whole or in part:

  • a) for legitimate reasons to process personal data concerning him/her, even if pertinent to the purpose of collection;
  • b) the processing of personal data concerning him/her for the purpose of sending advertising or direct sales material or for carrying out market research or commercial communication.

8. Transfer of data abroad

 

Your personal data will be processed by CGF Design S.r.l. within the territory of the European Union. Should it become necessary for technical and/or operational reasons to use subjects located outside the European Union, or should it become necessary to transfer the collected data to technical systems and services managed in the cloud and located outside the European Union area, the processing will be regulated in compliance with the provisions of Chapter V of the European Regulation 679/2016 and authorised on the basis of specific European Union decisions. All necessary precautions will therefore be taken in order to ensure the fullest protection of personal data based on this transfer:

  • On appropriateness decisions of third country recipients made by the European Commission,
  • On adequate guarantees expressed by the third party recipient pursuant to Art. 46 of the European Regulation,
  • On the Adoption of Binding Corporate Rules.
